Recover or Reduce Overcharged Legal Fees
Our approach is very simple. Does your company,
or do you, owe substantial legal fees? If so, Carney & McKay will represent
you in seeking to bring about a reduction of your legal fees, at no cost to you
or to your company, and strictly on a contingent basis. See example.
A survey in a recent issue of The
American Lawyer disclosed that that the gross revenues of the 100 largest law firms in the
United States in 2005 totaled a whopping $51 billion ($51,000,000,000).
Of the 15 most profitable firms in the U.S., 14 of them are based in
New York. Nine of those had average profits in excess of
$2,000,000 per partner in 2005. [We do not mean to suggest that these law
firms, or any particular law firm, have necessarily overcharged their clients.
Nor do we mean to suggest that simply because a law firm has high billings
or profits, that it has overcharged its clients. Each matter must be examined
on a case-by-case basis.]
How Carney & McKay can help you save money, at no cost to you
Carney & McKay will defend you against your former law firm's claim
for fees, whether before or after a lawsuit (or arbitration/mediation proceeding)
is brought against you by your lawyers, and we will not charge you for this
service. We will represent you at no cost to you, even if the case has to
go to a jury trial. The only payment we will receive for our services will
be strictly on a contingent basis, and only if we are successful in obtaining
a reduction of the fees that your lawyers claim are owed to them.
If we do obtain a reduction, our contingent fee will be one-third of the amount
of the reduction; the remaining two-thirds will be what you have saved in legal
fees. In the event that we are not successful in obtaining a reduction of
your fees, there will be no charge for our services.
A specific example of how you can save a great deal of money
As an example, if your present or former lawyers claim
that your company or you owe them legal fees totaling $600,000, and they
have threatened or have brought a lawsuit or other proceeding against you
to recover that amount (plus interest, which is 9% per year in New York),
we will represent you for nothing in defending you through trial or hearing.
If the end result is that we achieve a reduction of $300,000 in the fees
that you owe, from $600,000 to $300,000, our fee would be one-third of the $300,000
reduction ($100,000), with the net result that you have saved $200,000. If
we achieve a reduction to $0 of the $600,000 claimed to be owed, our fee
will be the same one-third of the $600,000 reduction, i.e., $200,000, with the
net result that you have saved $400,000. In the event that we do not achieve
any reduction, you will owe us nothing except out of pocket expenses.
